Terms of service
Last updated: October 29, 2026
These terms govern your use of the Hatrack app for iPhone (“the app”) and this website. By creating an account or continuing to use the app, you agree to them. How we handle your personal data is explained in the privacy policy.
Who we are
Hatrack is operated by Kevin Detter, Carrer Serra Grossa, 10 - Vivienda 3, 03110 Mutxamel, Alicante, Spain (see the legal notice). Email: legal@hatrack.eu
Who can use Hatrack
You must be at least 16 years old to use the app. If you’re under 18, you need your parent’s or guardian’s permission. You’re responsible for keeping your login details safe and for what happens under your account.
What you can share
You can add hats to your collection, upload photos, set up a profile, comment on collected hats and submit new hats to the catalog. You’re responsible for everything you upload or write. Please don’t share:
- anything illegal, or anything that infringes someone else’s rights
- photos you don’t own or have no permission to use, including other people’s copyrighted photos
- harassment, hate speech, threats or other abusive content
- spam, ads or misleading content
- anything that isn’t a hat in the shared catalog
Your content and our license
Your photos, comments, profile and catalog submissions stay yours. To run the app, you give Hatrack a non-exclusive, free license to store, display and adapt them (for example, resize or crop) in the app and on the website. Adapting also covers technical processing that’s needed to run the app, like the automated photo analysis described in the privacy policy.
When you submit a hat to the catalog with “Share my photos with Hatrack” turned on, you give Hatrack a non-exclusive, worldwide, free, perpetual and irrevocable license to store, display and adapt the photos of that submission that are accepted into the catalog, to show them to everyone as part of the catalog, and to show off the catalog, for example in the App Store. You grant this license by submitting with the toggle on. It’s on by default if your profile is public and off if it’s private, and you can change it each time you submit a hat. This license continues after you delete your account.
When a hat you submitted is approved for the catalog, you also give Hatrack a perpetual, irrevocable, non-exclusive and free license to show its details (such as name, brand, colors and description) to all users in the app and on the website, and to edit them. This license continues after you delete your account.
Hatrack may also use catalog content, including catalog photos, to promote the app, for example in App Store screenshots, social media posts and share images. We never use your collection photos, profile or notes for this. We don’t have to withdraw promotional material that’s already published.
The license for all your other content ends when you delete your account, and that content is deleted with it. The only exceptions are hats and catalog photos accepted into the catalog, which stay available to other users without any link to you, as described in the privacy policy and on the support page.
Trademarks
Hatrack is an independent app. It isn’t affiliated with, endorsed or sponsored by MLB, New Era, or any team, league or brand shown in the app. All trademarks and logos belong to their owners and are only used to identify the hats.
Moderation and reports
Every hat submitted to the catalog is reviewed by a person before it’s published for other users.
Anyone can report content they think is illegal or breaks these rules, using the report option on a hat, a collected hat or a profile in the app, or by emailing legal@hatrack.eu. Please tell us what the content is and why you’re reporting it. We look at every report, decide in a timely, careful and objective way, and let you know the outcome.
Copyright complaints
If you believe content in the app infringes your copyright, you can report it as described above, or send a notice under the US Digital Millennium Copyright Act (DMCA) to our designated agent, registered with the US Copyright Office under DMCA-1082845:
Kevin Detter, Hatrack, Carrer Serra Grossa, 10 - Vivienda 3, 03110 Mutxamel, Alicante, Spain. Email: legal@hatrack.eu
Your notice must include:
- your physical or electronic signature
- the copyrighted work you believe is infringed
- the content you believe infringes it, with enough detail for us to find it in the app, such as the hat or the profile it appears on
- your name, address, phone number and email address
- a statement that you believe in good faith that the use isn’t authorized by the copyright owner, its agent or the law
- a statement that the information in your notice is accurate and, under penalty of perjury, that you’re the copyright owner or authorized to act on their behalf
If we remove your content after such a notice, we’ll tell you. If you believe it was removed by mistake or misidentified, you can send a counter-notice to the same address. It must include:
- your physical or electronic signature
- the content that was removed and where it appeared before
- a statement, under penalty of perjury, that you believe in good faith the content was removed by mistake or misidentification
- your name, address and phone number, and a statement that you consent to the jurisdiction of the US federal district court for your address (or, if you live outside the US, any judicial district in which we may be found) and that you’ll accept service of process from the person who sent the original notice
We forward the counter-notice to the person who sent the original notice. Unless they tell us within 10 business days that they’ve filed a court action, we may restore the content 10 to 14 business days after receiving the counter-notice.
Knowingly false notices or counter-notices can make you liable for damages. We close the accounts of users who repeatedly infringe others’ copyright.
If you break the rules
If content or an account breaks these terms or the law, we may remove the content, restrict features, or suspend or close the account. We’ll tell you what we did and why, and you can respond by emailing legal@hatrack.eu. We’ll review your response and tell you our decision. In serious cases, such as illegal content, we may act first and explain right away.
Leaving Hatrack
You can stop using the app at any time and delete your account in Settings › Delete account. This deletes your profile, collection and photos, and any hats you submitted that haven’t been approved yet, for good. Hats and photos already accepted into the catalog stay, without any link to you. If you want to keep a copy, download your data first in Settings › Download my data.
Availability and liability
Hatrack is free, and we don’t guarantee that it’s always available or free of errors. We may change, pause or discontinue features or the whole service.
As far as the law allows, we’re not liable for losses that arise from using the app, including lost data or content, other than losses caused by our intent or gross negligence. We’re also not responsible for what other users upload. Nothing in these terms limits liability that can’t be limited by law, or your rights as a consumer.
Apple
If you downloaded the app from the App Store, Apple’s standard license agreement for apps also applies to your use of the app, alongside these terms.
Changes to these terms
We may update these terms, for example when the app or the law changes. For material changes we’ll notify you by email or in the app. If you keep using the app after a change takes effect, you agree to the new terms. If you don’t, you can delete your account at any time.
Governing law
These terms are governed by Spanish law. If you’re a consumer, you keep the mandatory consumer protection rights of the country where you live, and you can also bring a claim in the courts there.
